Terms and Conditions

You must be at least 18 years of age and capable of forming a legally binding contract to use the Service. By using Lumyn, you represent and warrant that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at support@lumyn.studio if you suspect unauthorized access.

We reserve the right to terminate or suspend accounts that violate these Terms, contain false information, or are inactive for an extended period.

Lumyn is an AI-powered platform that enables users to generate short-form video content using large language models and AI video generation services. Core features include:

• AI-driven video and image generation via third-party providers (including Fal.ai)
• Script writing and prompt enhancement via OpenAI
• Character consistency across video scenes
• Automated video editing, transitions, and merging
• Cloud storage of generated assets

The Service is provided “as is” and features may change or be discontinued at any time without prior notice.

Access to AI generation features requires purchasing credits or subscribing to a paid plan. All payments are processed securely through Stripe. By making a purchase, you agree to Stripe’s terms of service in addition to these Terms.

• Credits are consumed when generating videos, images, transitions, or audio. Credits are non-transferable and have no cash value.
• Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date.
• Refunds: Credits consumed for failed generations will be refunded to your account. All other purchases are final and non-refundable unless required by applicable law.
• Pricing: We reserve the right to change pricing at any time. Existing subscribers will receive notice of price changes before they take effect.

Subject to your compliance with these Terms and applicable law, you retain ownership of the original content (e.g., text prompts and uploaded reference images) you submit to the Service. With respect to AI-generated outputs (videos, images):

• You are granted a non-exclusive, worldwide license to use, reproduce, and distribute the outputs generated from your inputs for personal and commercial purposes.
• You acknowledge that AI-generated outputs may not be eligible for copyright protection in all jurisdictions, and you accept sole responsibility for any legal claims related to content you publish.
• By submitting inputs, you grant us a limited license to process your content solely for the purpose of providing and improving the Service.

We do not claim ownership of your inputs. We will not sell your content to third parties for advertising purposes.

You agree not to use the Service to:

• Generate content that is illegal, defamatory, harassing, or threatening
• Create deepfakes or non-consensual synthetic media of real individuals
• Generate sexually explicit content involving minors (CSAM), in any form
• Produce content that violates third-party intellectual property rights
• Circumvent, disable, or interfere with the Service’s security features
• Scrape, crawl, or extract data from the Service without authorization
• Resell or sublicense access to the Service without our written permission
• Violate any applicable local, state, national, or international law or regulation

We reserve the right to suspend or terminate access and remove content that we determine, in our sole discretion, violates these terms or is otherwise harmful.

The Service integrates with third-party providers including but not limited to Fal.ai (video/image generation), OpenAI (text and script generation), Google Cloud Storage (asset storage), Stripe (payments), and Mixpanel (analytics). Your use of the Service is subject to the terms and privacy policies of these third parties. We are not responsible for the practices of third-party services.

The Lumyn name, logo, trademarks, software, and all Service content not generated by users are the exclusive property of Bigsur Ventures LLC and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works of our proprietary content without our express written consent.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. AI-GENERATED OUTPUTS MAY BE INACCURATE, BIASED, OR OFFENSIVE AND ARE PROVIDED WITHOUT ANY GUARANTEE OF QUALITY OR SUITABILITY.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BIGSUR VENTURES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Bigsur Ventures LLC and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your content, or your violation of these Terms.

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including ownership, disclaimers, indemnification, and limitation of liability) will survive.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in such courts.

We reserve the right to update these Terms at any time. When we do, we will revise the “Last updated” date at the top of this page. For material changes, we will provide notice via email or a prominent notice on the Service. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
